GENERAL TERMS OF USE OF THE SITE

The French Development Agency (Agence Française de Développement referred to below as ‘AFD’) welcomes you to the institutional site of Urban Projects Finance Initiative (referred to below as the ‘Site’), which presents the assignments and operation of the UPFI initiative.

I. ACCEPTANCE OF THE GENERAL TERMS OF USE

By accessing the Site, you acknowledge that you have read and accept all the terms of these general terms of use (GTU).

The GTU govern your use of the Site and the services offered by AFD on the Site.

The AFD reserves the right to modify and/or update these GTU at any time without notice. We highly recommend verifying and re-reading the GTU regularly.

II. SERVICES OFFERED BY THE AFD

1. Services

This Site was designed in French, English and Arabic.

The Site provides information on UPFI activities. This information is supplied in all relevant forms, particularly texts, data, images, photographs, etc. (referred to below as the ‘Content’).

The Site also proposes several services (newsletters, recent developments, publications, useful links…) as well as links to other sites or resources published by third parties (referred to below as ‘Linked Sites’). AFD draws your attention to these Linked Sites, which are indicated exclusively for your information and are in no way recommended or endorsed by the AFD. These Linked Sites are governed by their own general terms of use; it is up to you to read them when you access those sites.

2. Exemption from liability and exclusion of guarantees

You are responsible for the use you make of the Site. Consequently, the AFD cannot be held liable for damage of any kind that may result from the use of the Site and the services that are proposed on the Site or on Linked Sites.

All information and services provided on the Site are supplied for your convenience ‘as is’. The AFD cannot guarantee that the use of the Site will correspond to your requirements. Specifically, the AFD excludes any guarantee of quality, timeliness, exhaustiveness of translations, Content and services provided on the Site or on Linked Sites. The AFD also excludes any guarantee of performance, quality or security related to browsing the Site and the Linked Sites or to the use of the services offered on Site and the Linked Sites.

III- USER BEHAVIOUR

1. The User’s Responsability

The AFD holds all copyrights to the Site and the Services proposed. Consequently, you are prohibited from selling, adapting, modifying, reproducing, disseminating, transmitting, or using in any other way all or part of the Site and the services proposed, in any form and by any means whatsoever, on any current or future medium.

A user who does not comply with the laws and regulations in force runs the risk of being sued by the AFD.

2. Notifying abuse

The AFD is not subject to any general obligation to monitor or seek out illicit content. Nevertheless, the AFD endeavours to maintain the quality of the Content on the Site.

If you observe or consider that the Content displayed on the Site is clearly of an illicit nature, please notify this to the following address: info.upfi@afd.fr.

This notification must include the following elements: your surname, first name and middle name if any, your address, a copy of the Content that you feel is disputable and the URL address of the page in question plus the author of the disputed Content, as well as the reasons why you think the Content should be withdrawn. You may incur civil or penal sanctions for any abusive report.

3. Right to correction

If you feel that an element of the Content jeopardizes your image, you can exercise your right to correction (up to 200 lines) by writing to the following address: info.upfi@afd.fr.

Your application must contain: your surname, first name and middle name if any, your address, a copy of the Content that you feel is disputable and the URL address of the page or passage in question plus the author of the disputed Content, the passages of the message in question that you feel should be withdrawn or deleted. Your right of correction will be published within three days as from receipt of your message. You may incur civil or penal sanctions for any abusive notification.

IV – PRIVATE DATA

Your private data are collected to ensure the smooth operation of the Site and to satisfy the requirements of the law of 21 June 2004 on confidence in the digital economy. You undertake to provide true, accurate and complete information, and to update it if necessary. Information identified with an asterisk is mandatory to enable you to receive the newsletter or to register for certain events organized by UPFI and/or its partners. The AFD undertakes to see that the collection and processing of private data are done in compliance with the Data Protection Act (loi Informatique et Libertés) of 6 January 1978.

The person responsible for processing the data is the Projects Management Unit UPFI, TRANSTEC, duly appointed by AFD.

Cookies existing on the Site are there for the smooth operation of the Site and will not be used to collect private data concerning you.

In compliance with the Data Protection Act of 6 January 1978, you have the right to oppose, modify, correct and/or delete all private data concerning you that were collected in relation to the use of the Site, by writing to the following address: info.upfi@afd.fr.
